Terms of Service
These terms apply when you use zindua.run, our APIs, dashboard, and related services operated by Zindua.

1. Agreement
By creating an account, accessing our website, or using our APIs, you agree to these Terms of Service ("Terms"). If you use Zindua on behalf of an organization, you represent that you have authority to bind that organization.
If you do not agree, do not use the service. We may update these Terms; continued use after changes constitutes acceptance. Material changes will be communicated via email or the dashboard when practicable.
2. The service
Zindua provides infrastructure for developers to send transactional email and WhatsApp OTP messages through connected providers (e.g. Gmail, Outlook, SMTP) and our delivery queue. Features, quotas, and pricing depend on your subscription plan.
We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (email providers, WhatsApp, cloud hosts), or force majeure may affect delivery.
3. Accounts & security
You must provide accurate registration information and keep credentials secure. OTP codes and API keys are confidential — you are responsible for activity under your account.
You must notify us promptly at support@zindua.run if you suspect unauthorized access.
4. Acceptable use
You agree not to use Zindua to:
- Send spam, phishing, malware, or unlawful content
- Harass, threaten, or violate others' rights
- Circumvent quotas, rate limits, or security controls
- Impersonate others or misrepresent message origin without lawful basis
- Violate WhatsApp, email provider, or anti-spam laws (CAN-SPAM, GDPR, etc.)
- Probe or attack our systems without written permission
We may suspend or terminate accounts that violate these rules or pose risk to deliverability or other users.
5. Your content & data
You retain ownership of templates, recipient data, and message content you submit. You grant us a limited license to process, store, transmit, and display that data solely to operate the service, support you, and comply with law.
You are responsible for having a lawful basis to contact recipients and for honouring opt-out and data-subject requests applicable to your use case.
6. Fees & billing
Paid plans are billed according to the pricing shown at checkout or in your dashboard. Usage beyond plan limits may be blocked or require an upgrade. Refunds are handled per our billing policy unless required otherwise by law.

7. Third-party services
Zindua integrates with third parties (email providers, WhatsApp via linked devices, payment processors, hosting). Their terms apply to your use of those services. We are not responsible for third-party failures or policy changes.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZINDUA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE.
Our aggregate liability for claims relating to the service shall not exceed the fees you paid to us in the twelve (12) months before the claim, or one hundred US dollars (USD 100), whichever is greater.
10. Indemnification
You will defend and indemnify Zindua against claims arising from your content, your violation of these Terms, or your violation of applicable law, except where caused by our gross negligence or willful misconduct.
11. Termination
You may stop using the service at any time. We may suspend or terminate access for breach, non-payment, or operational reasons. Upon termination, your right to use the service ends; provisions that by nature should survive (liability limits, indemnity, governing law) remain in effect.
12. Governing law & contact
These Terms are governed by the laws applicable to Zindua's place of incorporation, without regard to conflict-of-law rules. Disputes shall be resolved in the courts of that jurisdiction unless mandatory local law requires otherwise.
